Select any category below to understand its legal significance, statutory restrictions, and conveyance implications under the Gujarat Land Revenue Code, 1879:
Old Tenure (જૂની શરત - Freehold): Unrestricted agricultural tenure. The recorded occupant holds full alienation rights to sell, mortgage, gift, or partition the land without requiring prior administrative sanction from the Mamlatdar or District Collector, subject to general tenancy laws.
New Restricted Tenure (નવી શરત - Restricted): Land granted under post-independence land reforms, agricultural tenancy grants under Section 43 of the Bombay Tenancy and Agricultural Lands Act, 1948 (as applicable to Gujarat), or tribal protections under Section 73AA of the Gujarat Land Revenue Code, 1879. Sale, transfer, or non-agricultural (NA) conversion requires prior written permission from the District Collector and payment of prescribed state premium (Najarana). Transfers attempted without mandatory statutory sanction are void under state revenue law.
1. Understanding Gujarat Land Records
Gujarat maintains comprehensive electronic land records through its Revenue Department and computerized e-Dhara infrastructure. Under the Gujarat Land Revenue Code, 1879 and the Gujarat Collector Manual, village land administration relies on distinct statutory forms:
૭ - અધિકાર પત્રક): Contains landholder details, Block or Survey numbers, tenure classification (Old Tenure or New Restricted Tenure), land area, assessment cesses, and recorded encumbrances or secondary rights. Under a landmark 2012 state government circular, Gujarat formally separated Village Form 7 from Village Form 12 in the digital database, enabling citizens to inspect and verify rights independently of seasonal crop variations.
૧૨ - પાણી પત્રક): Records agricultural and cultivation particulars, including seasonal crops sown, irrigation sources, uncultivated fallow land, and tree censuses.
૮-અ - ખાતા વહી): The consolidated landholder ledger detailing all survey and block parcels held by a specific Khatedar within that revenue village, including total acreage and aggregate land revenue assessment.
૬ - હક્ક પત્રક): The statutory mutation register recording all reported changes in land rights, sales, inheritance succession, partitions, and mortgage liens, governed by mandatory Section 135-D public notices.
2. Official Gujarat Land-Record Services
Citizens, farmers, and property buyers should access Gujarat land records exclusively through authorized state government services:
- AnyRoR Official Portal: AnyRoR Gujarat Portal provides instant online access to view rural land records (VF 7, VF 12, VF 8A, VF 6 entries) and urban City Survey property records.
- Gujarat e-Governance (GIL) e-Dhara Information: Detailed project architecture and citizen charter documentation are published on the Gujarat Informatics Limited Portal.
- Gujarat Revenue Department: Departmental circulars, non-agricultural (NA) orders, and land revenue policies are published on the Gujarat Revenue Department Official Portal.
- e-Dhara Kendras: Dedicated citizen facilitation centres situated at each Taluka Mamlatdar office, providing biometric authentication, digitally signed RoR extracts, and mutation application lodgment.

- Input the security captcha and click Get Record Detail to inspect the digitized extract on screen.
4. Understanding Important Record Entries
Carefully analyze the specific entries appearing on Gujarat land records:
- Old Tenure vs New Restricted Tenure: Old Tenure (જૂની શરત) indicates freehold land transferable without state permission. New Restricted Tenure (નવી શરત) indicates conditional land granted under land ceiling or tenancy reforms; sale, transfer, or non-agricultural use requires prior written sanction from the District Collector and payment of state premium (Najarana).
- Section 73AA Tribal Restrictions: Land held by Scheduled Tribe agriculturists cannot be transferred, sold, leased, or mortgaged to a non-tribal person without prior written approval from the District Collector. Any conveyance attempted in violation of Section 73AA is void under the Gujarat Land Revenue Code, 1879.
- Section 135-D Notice and Statutory Certification Timelines: When a mutation is entered in Village Form 6, the procedure and timelines are governed by Section 135-D of the GLRC read with Rule 107(4A) of the Gujarat Land Revenue Rules:
- Same-Day Digital Certification without Notice (2026 Section 135-D Amendment): Registered sale deeds qualify for immediate certification without Section 135-D notice when three cumulative statutory conditions are fulfilled: (1) no changes recorded in the Record of Rights for at least one preceding year prior to the sale deed, (2) every recorded landholder executes the registered conveyance, and (3) no dispute or litigation is pending before any competent authority, revenue court, or tribunal.
- Direct Certification Forthwith: Entries resulting from binding orders or final decrees of competent revenue authorities, tribunals, or civil courts are certified forthwith without intimation.
- 10-Day Decision Window (Rule 107(4A) 2022 Amendment): Uncontested bank mortgage discharges and institutional hypothecations are decided within 10 days of notice service if no written objection is lodged.
- 7-Day Objection Window (Revised Rule 107(4A)): Applies to specified expedited mutation categories requiring public notice verification.
- Standard 30-Day Objection Period: Serves as the general statutory baseline for contested, complex, or unclassified land revenue mutations. Citizens should verify entry classification against the Gujarat Government Gazette and taluka e-Dhara records.
- Recorded Encumbrances (બોજો): Bank agricultural loans, institutional hypothecations, or government recovery liens are entered in the Other Rights column. Releasing an encumbrance requires an official No Dues Certificate and a certified Form 6 mutation.
5. What Is e-Dhara?
e-Dhara is the flagship digital land administration programme of the Government of Gujarat, designed to eliminate procedural delays and manual manipulation in village land records. Governed by the Department of Revenue, e-Dhara operates computerized counters across all Taluka Mamlatdar offices, ensuring that every land mutation follows strict digital workflow checks, transparent public notices, and centralized database updates.
6. What Should Buyers Verify Before Purchasing Land in Gujarat?
Prospective purchasers must conduct comprehensive due diligence before executing agricultural or non-agricultural land transactions:
- Bona Fide Agriculturist Status: Under Section 63 of the Gujarat Tenancy and Agricultural Lands Act, 1948 and Section 54 of the Saurashtra Gharkhed, Tenancy Settlement and Agricultural Lands Ordinance, 1949, agricultural land can only be acquired by a certified agriculturist (ખેડૂત ખાતેદાર), unless explicit permission is granted by the District Collector.
- Verify Title Chain & Registered Deeds: Commission an independent 30-year title search at the jurisdictional Sub-Registrar Office to inspect all historical registered conveyance deeds (દસ્તાવેજ), rather than relying solely on AnyRoR entries.
- Non-Agricultural (NA) Permission: If purchasing converted land for commercial or residential development, verify that an official Non-Agricultural Order has been passed by the Collector under Section 65 of the Gujarat Land Revenue Code, 1879.
- Inspect Village Form 6 Mutations: Check all historical mutation entries to verify that succession, family partitions, and registered transfers were certified without pending revenue appeals before the Prant Officer or Collector.
- Physical Ground Demarcation: Confirm that physical boundary marks correspond with official DILR (District Inspector of Land Records) measurement sheets and Village Form 7 acreage.
7. Legal Limitations of Revenue Records
Revenue records on AnyRoR are maintained primarily for the fiscal assessment and collection of land revenue. In line with definitive rulings of the Supreme Court of India, mutation entries and revenue ledgers do not create, extinguish, or transfer legal title. Marketable title must be established through registered deeds of conveyance, valid succession documents, and clear title chain verification by a qualified advocate.

(Old vs New Tenure)
